Abstract
Artificial Intelligence is the tool of the era, the integration of artificial intelligence (AI) into the Graphic design process presents a transformative yet complex dynamic, raising significant challenges concerning originality and intellectual property rights (IPR). AI's capabilities in generating designs—ranging from visual art to concepts — have redefined creativity by leveraging vast datasets and algorithms to produce outputs that mimic or extend human ingenuity. However, this progress introduces legal and ethical dilemmas. Determining authorship and ownership of AI-generated works remains contentious, as traditional copyright frameworks were built to address human creators, not autonomous systems. Furthermore, questions arise about the originality of designs derived from datasets potentially influenced by pre-existing works, raising concerns of copyright transgression and fair use. The blurred boundaries between AI as a tool versus an independent creator amplify these challenges, requiring a reevaluation of legal standards and intellectual property policies. This paper examines the interplay between AI-driven design, originality, and IPR, exploring the technological, legal, and ethical dimensions. It highlights current gaps in regulatory frameworks and offers insights into potential solutions, including updated definitions of authorship, the role of AI developers, and the ethical use of training datasets. The study emphasizes the necessity of interdisciplinary collaboration between technologists, legal experts, and policymakers to ensure equitable outcomes in an era where AI increasingly shapes creative industries. Addressing these challenges is critical to fostering innovation while safeguarding the rights of creators and the integrity of intellectual property systems.
